采购招标公告

中国 (略) 承接了哥伦比亚波 (略) 线项目，拟对项目车辆段工艺设备集成包2#（详见招标文件）进行招标， (略) ：METRO1/TEN/M&E/2022/0009。诚邀市场业绩和商业信誉良好且符合投标资格要求的企业参与本次招投标，本次招标采用电子化招标投标方式。

1.招标文件发放时间：2022年04月24日至2022年05月05日（北京时间）。

2.招标文件发放方式：通过中国交建供应链管理信息系统（http:/ *** ）以公开招标的方式发放。

3.投标文件递交截止时间：2022年05月20日08:30（北京时间）。

4.投标文件递交地点：

（1）按规定将电子版投标文件上传至中国交建供应链管理信息系统；

5.开标地点：中国交建供应链管理信息系统

6.开标时间：投标截止日当日在中国交建供应链管理信息系统（http:/ *** ）上开标，招标人有权推迟开标。

Bidders should be legal persons registered in People’s Republic of China, Republic of Colombia or a third country with good financial status, whose corporate purpose matches with the purpose of this Tender process, who are not involved in any conflict of interest under the terms established by the Tenderer, and that have experience, knowledge, and capacity to present the proposal and to celebrate and perform the contract.

投标人应是在中华人民共和国境内，哥伦比亚共和国境内或第三国注册的法人，具有良好的财务状况保证项目履约，其公司经营业务与满足本次招标要求，在招标人制定的条款下不涉及任何利益冲突，并且有经验、知识和能力提交投标书以及履行合同。

7.1 The Bidders shall be the manufacturers or integrators that meet all the requirements of technical specification and quality standard of products, stated in the tender documents. Dealers are not acceptable for this Tender.

投标人应是满足 (略) 列产品技术规范和 (略) 有要求的制造商或集成商。本次招标不予考虑代理商。

7.2 The Bidder shall provide project experience information in the past five (5) years which complies the requirements of: I) The bidder shall have not less than five (5) supply contracts of depot engineering vehicles in rail transit industry, proven with the supply contracts and certificate of delivery; II) At least one (1) overseas supply contract of depot engineering vehicles.

投标人应提供近5年内符合以下要求的项目业绩资料：I）投标人在轨道交通中车辆段工程车的供货业绩不少于5个，并提供供货合同及交付证明；II) 至少有1个车辆段工程车海外供货业绩。

7.3Consortium bid is not acceptable for this Tender.

本次招标不接受联合体投标。

7.4The Bidders shall not be involved in any Prohibited Practices, which include: (i) corrupt practices;(ii) fraudulent practices; (iii) coercive practices; (iv) collusive practices; (v) obstructive practices.

投标人不得参与任何禁止行为，包括：（i）腐败行为；（ii）欺诈行为；（iii）胁迫行为；（iv）串通行为；（v）妨碍行为。

7.5The Bidders shall not be in the penalty list of Multilateral Entity and shall not have a serious legal risk.

投标人不得出现在多边 (略) 罚名单中，也不得有严重的法律风险。

7.6Should there be any Bidders fail to fulfil clause 3 requirement stated hereinabove; the Tenderer may invalidate and disqualify their participation in this process.

如有任何投标人不符合上述第3条的要求，招标人可取消其参与该投标程序的资格。

在此阶段，招标人将检查提交的文件是否符合招标文件的要求。如果发现以下情况，投标人将被否决：

(1) Bidding documents which are incomplete or not substantially responsive.

投标文件不完整，或者没有进行实质性响应；

(2) The bidding document is NOT MARKED as per the instruction.

投标文件未按说明进行标记。

(3) There is no authorized digital signatory and company official stamp.

(4) The validity period of offer is not according to (or shorter than) the tender request.

投标文件有效期不符合（或短于）招标文件要求的时间。

(5) Any bidder who might have submitted TWO (2) different sets of tender documents in different content of offer and NOT clarifying which one is the MAIN tender content and which one is the ALTERNATIVE.

任何投标人可能已经提交了两（2）套不同报价内容的不同投标文件，并且没有清楚说明主要报价和备选报价。

(6) Bidder who has quoted more than two different unit price to a specified similar product.

投标人对指定的类似产品报价超过两个不同单价。

(7) The product and services quoted is NOT in substantial standard requested in the tender.

报价的产品和服务不符合招标文件要求的实质性标准。

(8) The Bidder didn’t submit the Bid bond according to requirements of Tender document.

投标人未按招标文件要求提交投标保证金或投标保证金不符合招标文件要求。

(9) The bidder submits the tender documents in an illegal way.

投标人以非法方式提交投标文件。

(10) The Bidder’s qualification doesn’t meet the requirements of the tender documents.

投标人的资格不符合招标文件的要求。

(11) According to the evaluation of the evaluation committee, there is a serious financial and/or legal risk for the execution of the work from the bidder.

经评标委员会审查，投标人存在对招标人的工作执行有较大影响的财务风险或法律风险

(12) For the equipment offered by the Bidders according to the Form 6.1 Equipment Quotation, the bid evaluation committee shall evaluate and level the equipment based on Form *** -1 Equipment Level Regulation. After the level evaluation, the proportion of the 1st level equipment in the Bidder"s equipment list exceeds 20% of the total number of equipment.

对于投标人根据格式6.1所报的设备报价表中的设备，评标委员会将按照表 *** -1的设备分档规则进行评估并分档。经过分档后，投标人设备列表中的第1档设备数量占总设备数量的比例超过20%。

The determination of the abovementioned decision shall be jointly confirmed by the Procurement Department of China Harbour Engineering Company and the Tender assessment team.

上述废标的认定由中国 (略) (略) 和评标专家小组共同确认。

9.投标保证金

投标保证金采用银行保函或银行电汇形式，银行保函可由招标人认可的中国境内银行开具，并符合招标人的保函格式要求。投标保证金为人民币80万元整（人民币 *** *** 万元整）。投标保证金的有效期应为截标日期起270个日历日。在此期间，投标人不得撤回投标文件，否则招标人有权没收投标保证金；投标保证金须在开标之日前电汇完毕并 (略) ，汇单或投标保函须在开标之日前提交原件。

投标保证金待开标后，在招标文件规定的期限内退还投标人。未中标投标人的投标保证金退还时间为招标人与中标人签订合同后的15个工作日内。中标投标人的投标保证金退还时间为双方签订合同且招标方收到履约保函原件后15个工作日内。招标人退还投标人的投标保证金或履约保函均是无息的。

10.出现下列情况时，招标人不会向投标人退还投标保证金，并保留索赔权：

(1) The Bidder withdraws or cancel the Bid viciously within the validity date;

投标人在有效期内恶意撤回或取消投标；

(2) The successful Bidder did not supply the performance guaranty before the requested deadline;

中标人未在要求的截止时间前提供履约保函；

(3) The successful Bidder did not sign the procurement contract with the Tenderer before the requested deadline.

中标人未在要求的截止时间前与招标人签订采购合同；

(4) The successful Bidder subcontract the project to other company without the approval from the Tenderer.

中标人未经招标人批准 (略) ；

(5) The successful Bidder did not perform the contract after signing (force majeure excluded)

中标人在签署合同后并未履行合同（不可抗力因素除外）；

(6) Other behaviors that against the Law of China and the requirement of the Tender.
